By use of this platform, you agree to be bound by these terms of service. 

Account Creation and Security

You may need to create an account in order to access and use certain parts of the platform. Users are responsible for keeping the login credentials confidential and safe. For this reason, Users are required to choose passwords that meet the highest standards of strength permitted by Trucky. You agree that all of the details you provide in connection with your account are about yourself and not about other individuals. All information given must be valid and up to date. You are responsible for your account yourself and have to make sure that no third party or any other individual can access it. 

Account Suspension or Termination

Trucky reserves the right to investigate any actual or suspected violations of these Terms of Use performed on User’s account at any time and without notice at Trucky sole discretion. If it is found such a violation has occurred Trucky is under its full rights to suspend or terminate your account and refuse you access to your account or Trucky for any reason. 

User Content

Certain aspects of the site allow the User to upload content to the site, which may include: files, text, images, videos and other content directly through the Service or through a Third Party Service. 

Content Ownership and Licensing:

• Ownership: All User Content uploaded to TruckyMods.io is owned by the original creator. Uploading content does not transfer ownership to TruckyMods.io or any other party.
• Licensing: By submitting or posting User Content to the Service, you grant TruckyMods.io a royalty-free, non-exclusive, unrestricted, worldwide license to use, distribute, publicly display, transmit, communicate to the public, and modify the User Content by any means and in all media formats and channels now known or hereafter devised, in perpetuity, and to advertise and promote such use.
• Content Transfer: In the event of an acquisition of TruckyMods.io by another entity the rights and licenses granted to TruckyMods.io for User Content will transfer to the acquiring entity, ensuring continuity of service. Users will be informed of such a transfer and have the right to remove their content if they do not agree with the new arrangement.

Content Removal:

• Creator-Initiated Removal: Only the original creator of the User Content has the right to request the removal of their content from TruckyMods.io. TruckyMods.io will comply with such requests and ensure the content is irrevocably deleted from its servers.
• Distribution Role: TruckyMods.io acts solely as a distribution channel for User Content and does not assume ownership or editorial control over the content. TruckyMods.io is not responsible for the removal or modification of content unless requested by the original creator or required by law.

Handling Copyright Issues:

• Intermediary Role: TruckyMods.io may, but is not obligated to, act as an intermediary between the original content creator and parties raising copyright issues. All copyright claims must be directed to the original creator.
• Notification: If TruckyMods.io is notified of a potential copyright infringement, we may inform the original creator and, at our discretion, assist in facilitating communication between the parties involved. TruckyMods.io will not be responsible for resolving such disputes.

Please be aware that User Content is not confidential and may be accessible by other users and the public. As soon as you decide to delete your User Content, we will irrevocably delete it from our servers. Please retain copies of all User Content, as this Site is under no obligation to store or return any User Content to you.

TruckyMods.io only acts as a passive conduit for User Content and will not be liable for any use, disclosure, or exposure of any User Content, including possibly objectionable or offensive User Content, to you, any other user, or any third party. TruckyMods.io is under no obligation to monitor User Content or use of the site. However, TruckyMods.io reserves the right to monitor or moderate User Content at our sole discretion and to enforce our or a third party’s intellectual property rights in any User Content. TruckyMods.io reserves the right to discard or remove User Content from the Site at its sole discretion and without any liability.

You represent and warrant that your User Content does not infringe, violate, or misappropriate any third-party intellectual property rights, including copyrights or trademarks. Your User Content, as used in connection with the Site, will not violate any applicable laws or regulations or infringe or violate any rights of a third party.

TruckyMods.io is not responsible for any issues modifications cause, such as crashes, the modifications not working, or any other related issues. TruckyMods.io is not responsible for providing support to Users in regard to any modifications they downloaded not working.

Limitation of Liability

• Distribution Role: TruckyMods.io’s role is limited to providing a platform for the distribution of User Content. TruckyMods.io is not responsible for the content's legality, reliability, or quality.
• Indemnity: Users agree to indemnify and hold harmless TruckyMods.io from any claims, damages, liabilities, costs, or expenses arising from their User Content or use of the platform.

Dispute Resolution

• Governing Law: These Terms of Use and any disputes arising from them will be governed by and construed in accordance with the laws of the jurisdiction in which TruckyMods.io operates.
• Arbitration: Any disputes arising under these Terms of Use will be resolved through binding arbitration in accordance with the rules of the relevant arbitration association, rather than in court, except that users may assert claims in small claims court if their claims qualify.

Changes to These Terms of Use

Trucky reserves the right to update these Terms of Use at any time. When we do, we will send out an email and post a notification on the main page of our site. You acknowledge that it is your responsibility to review these Terms of Use periodically and become aware of any changes. 

Copyright Agent

If you believe that any User Content or other material on the Site infringes your copyright right, please contact us with the exact URL of where the alleged infringing material is located. If we are notified that any User Content infringes another’s intellectual property rights, we may remove such User Content. We have a repeat offender policy and reserve the right to terminate your Account for submitting infringing User Content in violation of these Terms of Use once or on a repeated basis. 

Reward Program and Ad Revenue Distribution

TruckyMods.io distributes ad revenues to creators who apply to the Reward Program in proportion to the number of downloads they generate.

• Revenue Distribution: All ad revenues are divided among creators participating in the Reward Program and are paid directly to their PayPal accounts every month, provided they have reached the minimum threshold of $5 USD. Ad revenues vary each month based on site traffic and can fluctuate significantly due to seasonality.
• Payout Schedule: Payouts are expected to be performed before the 10th of the following month.

Disclaimer of Warranties

Your use of the Site and the User content, is at your own risk, and Trucky is provided “as is” without warranties of any kind, either express or implied. Trucky does not warrant that the service will be available, uninterrupted, secure or error-free, that defects will be corrected, or that the service or the servers that make service available are free of viruses or other harmful components. Trucky does not accept liability for any loss or damage arising from your use of the Site. 

Email Communications

By creating an account you acknowledge that we may send an email to the address associated with your account with important information regarding your account, as well as our services and policies. However, you are free to opt-out from emails that do not contain important information regarding your account or our service by letting us know that you no longer wish to receive such emails.
